The opposing attorneys by requesting discovery documents want to find out how much in the way of assets you have. Are you the only wage earner? If so, you disability payments are exempt. If you wife is a wage earner her's may not be. As far as removing your wife's name from the court papers that will probably be a problem because, basically, each parent is responsible for the care of their children regardless of whether one has/has no insurance. Florida is one of the better states as far as wage garnishment (very hard to get) but if you allow a judgement to be entered that could very well pose a problem for you. What county/city do you reside in?
Next, do a search on www.google.com or www.yahoo.com (use keywords "florida wage garnishment" or something to that effect)- then read/research what's on those sites. Did you have an attorney act on your behalf for the disability? If so, contact them for assistance. You may also be able to contact an attorney for a "free" initial consultation - Look in the Yellow Pages. Hope this helps.
