The letter below is pretty much my story in a nutshell, I sent it March 18 and received signature confirmation...No one has contacted me about this letter! I get collection calls from them everyday, but no one knows about the letter. I sent it to the president after tons of letters to customer service and collections....

Does anyone know what I should do next? I am trying to buy a house and this is a major derogatory on my credit report...

Dear Mr. Harrison,

Thank you for taking the time to read this letter. I am turning to you after many failed attempts of trying to work this out with your company’s customer service representatives.

In March of 1997 I had some financial difficulty and went through Consumer Credit Counseling Service (CCCS) of San Francisco to pay off my balance with Chase Manhattan (which was about $900 at the time) and other credit cards. Everything went good, as far as I knew, until January 2001 when I wanted to pay off the remainder balance with your company. Up until then, neither I, nor CCCS had received any correspondence from your company. I paid off all of the other credit cards through CCCS and there were no problems to speak of. When I called Chase Manhattan to get the exact amount of what I owed (which I estimated at about $150) they advised me that I owed about $2800 more! I could not believe this! I had a balance of $900 to start with and had already paid $800 towards it. After a few threatening phone calls from your “customer service” representatives, I paid a couple more payments of about $300.00 all the while I was still paying $75.00 per month with CCCS. Finally in November of 2002, I stopped making payments to Chase. It was clear that nobody at Chase wanted to help me and I had already, at that time made about $1500 in payments toward an original balance of $900 and spent countless hours of my precious time trying to fix the matter with customer service reps. After many different stories from several employees of Chase, I still do not have any acceptable reason for the balance of my account (which is now over $3200 and growing by the minute). They say that in October 1997, I had a late payment and was dropped from the payment plan. Neither I, nor CCCS received notification of this at all. Therefore, I kept making my payments on time every month to CCCS who sent them to Chase.

Now let’s get to the balance. Three thousand two hundred dollars? How could that happen? Well, let me tell you. Chase has charged me 21% interest every month, even though the negotiated amount with CCCS was about 10%. On top of the 21% interest I have been charged a $29 late fee EVERY MONTH! Since I have never made a late payment to CCCS and they claim that they have never made a late payment to Chase, I want to know how your company has charged me so much in late fees! And even better, I have been charged a $29 over-the-limit fee EVERY MONTH!!! One would wonder how it is possible to be charged an over-the-limit fee for a credit card that has been out of use (and should have been closed by Chase) for 5 years now. As I said before, I had no problems to speak of with any of the other credit cards I paid off through CCCS, why only Chase Manhattan?

The customer service representatives that I have spoken to are less than adequately trained to handle this matter. I don’t know your policy on giving information over the phone, but my wife could not even get any reps to give them their names and one representative said that they do not even have managers and WOULD NOT TELL HER WHO THE PRESIDENT OF THE COMPANY is. I work in a professional office for the government and I know that there is a chain of command that just about every major corporation has, why won’t your representatives let us know who to contact? We wrote a couple of letters to an address in Phoenix, AZ and their way of “helping” us was to send a computerized letter telling us to call an 800 number. When my wife called the phone number, no one knew what was going on with the account and they tried to just pressure her to pay off the balance, threatening legal action if she didn’t. They also told her that I am too young (31) and if I were 80 years old, they might be more helpful because I would “DIE SOON”. Is that how your employees decide who to help? Which clients are going to kick the bucket first? This is no way to handle customers I don’t even think it’s lawful.

Please give this matter the attention it deserves! I want the balance on the credit card wiped out and the negative feedback on my credit report fixed. I already paid about $1500 in payments to a $900 balance. If you add that up with the hundreds of hours I have spent dealing with the harassing phone calls and letters from your company, it totals to much more than $900 plus 10% interest accrued in the last 5 years. If this is not resolved within 21 days, I will be forced to obtain legal assistance in dealing with this matter.
