I think I should rephrase my previous post. I had a lady from an attorney's office in Alabama call me and state she had two civil warrants ready to serve, on my husband's old circuit city credit card, for $1500 and also a warrant to attach to the property, or merchandise purchased on the card. She has offered a settlement of $1051.00. This is the first I have heard from her, I have nothing from this Attorney Bracken's office. Should I request validation of the debt from the attorney's office? I am sure they are just a collection agency attorney, does the same apply? Shouldn't I request something in writing first? Can they serve without sending something else prior? Also, I know that she may just be threatening, but will they actually follow-through for a small amount like that? Our credit is pretty shot anyway, the last payment showing is 02/23/01, and I have ordered a copy of the credit report to see when we were last delinquent, which was prior to that. I don't want to buck the system, we do owe the money, and if I had to choose, I would rather pay the 1051.00 rather than the 1500 with the addtl 1000 for the attorney's fees and court costs, with garnishment. Sorry for the long post, but I figured I would give all the info. We are in Georgia.
