Contact the clerk of the court and see if this is a lagit case first and who actually served the summons. A summons is usually delivered by the sheriff, CRRR if that state allows for it and process server. If it was delivered by the lawyers office you have grounds for improper service. They cant serve you themselves it has to be a 3rd party.

If the case has not been filed then the summons is a violation of the FDPCA.
