Silly Collection Agency, Inc.:
I have recently received a copy of my Experian credit report. This credit report now shows a 60 day delinquent account from Silly Collection Agency, Inc..
Please be aware that I have sent Silly Collection Agency, Inc. two certified mail dispute letters. My certified return receipt cards show that these letters were signed for by Silly Collection Agency, Inc. on January 2nd, 2002 and March 25th, 2002.
Your failure to follow that law has forced me to draft a lawsuit against Silly Collection Agency, Inc. for the following:
1) Violation of the Fair Credit Reporting Act
2) Violation of the Fair Debt Collection Practices Act
3) Defamation of Credit
4) Negligence
5) Loss of Opportunity
6) Injunction seeking immediate court ordered relief from further credit damage.
This is an offer of an out of court settlement prior to the lawsuit being filed. If you will agree to delete all information from my credit reports immediately, then I will agree to not seek the damages to which I am entitled.
If you do not delete this information from my credit report, then my lawsuit will be filed, April 29th, 2002 in Florida Circuit Court. Since the contract that is in dispute originated in my county, that entitles me to file in Florida. I will be seeking damages in excess of $15,000.
If you wish to notify me that you are agreeing to delete all information from my credit reports and closing this matter, you must call prior the close of business on Friday, April 26th, 2002.
