On November 16, 2001, the Division entered into an Assurance with Weltman Weinberg & Reis Co., LPA, Attorneys at Law, of Cleveland, Ohio, arising from the company's unlawful debt collection practices in West Virginia. The Division's investigation was prompted by the complaint of a consumer who received debt collection notices from the law firm, which did not have a license issued by the tax department to collect debts in West Virginia. Further investigation also disclosed that the firm had no signed contracts, sales slips, or any other documents to verify the existence of the credit card debt that it sought to collect from the consumer, a debt which the consumer had long disputed.
The Assurance required the law firm to obtain a West Virginia business license and post a surety bond in the amount of $5,000.00 with the tax department for each principal office and all branch offices before engaging in any further debt collection activity in West Virginia. The Assurance also required the law firm to dismiss the collection suit filed against the consumer, cancel the alleged debt of $4,675.63, and pay $1,000.00 to the consumer, for a total of $5,675.63
