OK, I read aaaaalllllllll the way back to the original information. You said you had a credit report showing this debt charged off in 9/96, right? (Feb. post) - so D&N charged it off in 9/96 - that means the original delinquency date prior to the charge off was 3/96 (it's 180 days).

The 2001 entry on your credit report is from Republic Bank when they purchased D&N Bank. They had no right to report this in this manner - it re-aged the debt for reporting purposes, and is illegal.

Also, your SOL is up, and even if they did sue you (it doesn't sound like they're going to do that BTW, it sounds like they are trying to get the entire story because you raised the issue, but of course they would say you owe them the money when they are talking to you over the phone).

Do you still have that credit report that showed the original charge off date? If you do, that is all you need.

Send Becky a copy of that report, and a copy of the report showing the 2001 date that they entered, tell her the debt is past the SOL in MI, and that you originally contacted her to have their 2001 entry on you credit report removed, because they should never have done that.

Tell her that in 1996, you believed that you had repaid that debt, and you were not notified otherwise, but that whether or not you repaid it is irrelevant to the issue at hand, because the SOL is up. Now the issue is their inaccurate entry on your credit report.

And thank her for her help, LOL.

Don't make any threats unless they do, but you CAN make them remove this entry.

Actually they sound pretty nice, for a bank collection department.
