If you get your Experian report it will show when the 7 year reporting period allowed will end.This starts at your first "late" notice on the account. If you subtract 1 year from that date you will have the accurate SOL date for being sued. If the suit was filed AFTER that date you can accept service on the suit and respond in an answer that they are "time-barred" that is, the statute of limitations has expired. You need to DEFEND yourself with this SOL defense, it is not something automatic. On the other hand, if you are still within the SOL for being sued, you will eventually have to accept service or they will publish and get a default judgment. You SHOULD get a lawyer to help you on all this, if you have to declare BK he will be better able to advise you.
