The law says, in both the FCRA and the Equal Credit Opportunity Act, that no one is allowed to impair your credit without cause. The effect of their non reporting impairs your being able to obtain credit, therefore they are just as liable as if they reported false information. The key in this situation is- that they admitted thy report delinquent accounts. They are not allowed to pick and choose what credit they will report, they either report it all, or they report none.
