You need to have your mother send a dispute/validation letter to the collection agency requesting copies of the bill, a copy of her signed responsibility statement,copies of the insurance company's denial of claim.If the date of service was over 3 years ago,she cannot be sued,if it is under 3 years she cannot be sue while it is within the 30 day dispute period.If they cannot properly validate their claim, and they do sue, you have an affirmative defense. Send any letters rrr,keep all correspondence, check her credit reports.DO NOT try to do anything on the phone with anyone, just ask them to send a letter if they call.
