Usually, in the early stages of default an account is ASSIGNED to a collection agency.At that pont it ca be turned back to the original creditor if you send a cease and desist to the ca stating you will only do business with the original creditor.Later the account will be SOLD to a collection agency,normally it is not the same one that it may have bee assigned to previously.At that point,it may be beyond the SOL for legal action.
