Providian debt

I owe Providian a little over $3000. Hadn't paid in 5mths. The debt collector called my job and talked to my payroll account lady and told her they will serve papers on me. I set up some postdated payments. Initially the amt. was lowered to settle. Now the man says he can't help me. My checks were set up with checks that are used already b/c I only had depoist slips to go by at work. If I called and offered for the lowered amount, would I have to go to court?
