Ok, I am at the point where the so called attorneys for Citibank (Calvary Investments LLC)has sued me. I challenged it, went to the process of back and forth letters, etc. The courts has issued a date for me to appear (not a summons) if I want to orally dispute it. This is was a copy of the letter the courts sent to attorneys and CC it to me. I had sent a letter to the courts (had it dated and stamped)requesting that this case be dismissed due to the fact that the SOL has expired. I received no reply from the courts, just the general court date of the hearing. This bill became delinquent in 96 appeared to have been charged off in 9/97 and the SOL for Ga. (where I reside) is 4 years. Why wouldn't the courts automatically dismissed the case due to that fact? I definitely plan to go to court but what should I expect? Also I received the first letter of complaint (which I answered) in 2001. Does the SOL begin when the account becomes delinquent and not caught back up (96) or when they actually start the sueing process? I would appreciate any help since I am due to go to court soon. Thanks.
