If the creditor has not yet filed for a judgment,then all you have to do is notify him, in writing, with a copy to your lawyer, that your lawyer is handling your bankruptcy. By law, he cannot then file, if he does, and you are served with papers, then you answer the court with the notice you have filed and a copy of the notification to the creditor. Send your notice RRR.An expedited BK is used only when you have already been served and the hearing for a judgment is about to be held.
