They could consider it obtain property under false pretense. Once laid off unless otherwise stated in your ex employee handbook or policy. Once laid off or terminated all company property must be returned. I would return merchandise to store and state what happened and pay them money back along with returning their card back. If not you could see some serious problems down the road it seems this is more of criminal than financial or could lead to it if you do not take actions to resolve the matter quickly. Try to work with them see what they want to do then get it all in writing once a agreement is made.
