Even if a judgement is entered against you in court there are still laws in every state that limit what a creditor can "take." If you know for sure you will be sued and you definitely don't have the money to pay, you might consider bankruptcy. That would stop the action by sears and any other creditor you have (even if you don't plan on filing tell Sears' "lawyer" that you are considering it because of them). Credit counseling is an option also, but not all creditors are willing to go with the program and it still goes in your credit file.
