Have I waited too long to take action? Please help!

Greetings from Alabama! Fleet Bank has sent my charged off account to Phillips & Cohen Associates. My last payment to Fleet was 9/01. Balance is $5K. First phone conversation with P&C was 30 days ago. I was told that no payment plan could be set up. Anything less than amount owed would be reported to Fleet as refusal to pay. I have tried several ways to raise funds, to no avail. P&C rep says no further contact is necessary if I can not pay in full. I just now have discovered info on FDCPA. I have never received anything in writing from P&C. Have I waited too long to take action (letters, etc.)?
