Yes a judgment has to be obtained before anything LEGALLY can be done, however, some ca's use underhanded tricks and loopholes to seize first and ask questions later. To avoid having to get legal help to reclaim illegally seized funds, you should make sure the account is jointly held (with someone you absolutely trust) with their name as primary.(if you are in a community property State DO NOT use your spouse).
