I called the clerk and they told me that the summons is probably real, even if it doesn;t have an index number. Evidently the plaintiff has the option to buy an index number up to 14 days after the "call to answer" date has expired. Anyway- I called the attorney listed, and surprisingly got a very nice woman on the phone. I explained my situation to her, and she appeared to be very understanding. I told her I was laid off, told her I had no assests: no car, no house, no stock, etc... She asked what my settlement offer was, and I told her $2000 was my cap, and that it was a real stretch for me at that amount. I also told her I wanted an agreement in writing absolving me of any remaining balance, and that I wanted my credit report amended. She said that my report would be marked "settled" and that if we came to an agreement, the account would be considered closed. So now I am waiting for her to call back with an answer to my offer. I expect them to come back demanding at least $5000, but we'll see what happens. Good news is, it doesn;t look like I have to go to court. Also- she mentioned something about them notifying the IRS if we reach a settlement agreement. Any idea what this means? Why would the IRS care about a settlement offer between myself and a creditor?
