I thought I would throw my experience out there and see if anyone has any additional thoughts. I also got "served" by Wolpoff and Abramson via airborne with papers indicating that they have filed a claim with the National Arbitration Forum. They included a copy of the arbitration agreement that was part of my MBNA agreement (and is part of all current MBNA accounts). I am local to Wolpoff and they are famous for bringing suits to collect debts (sue, then garnish is their method). From what I understand Wolpoff's new procedure with MBNA is to go to arbitration, get the award, and then sue to have the award entered, then garnish. The arbitration award must be affirmed by the court before they can go after any money, but I suspect this is a rubber stamp type deal. In any event I am trying settle with them but they are refusing to budge much.
