I think my first post got lost, sorry if this is a duplicate. Recently I got "served" by airbone, much like a previous person had. It was a claim filed against me by Wolpoff and Abramson (law firm) on behalf of MBNA. It was filed with the National Arbitration Forum, for the principal of my balance (12k) plus 2k attorneys fees. They included a copy of the arbitration agreement that was part of my (and every other MBNA cardholders) agreement.
I'm local to Wolpoff so I know that their usual procedure is to sue and then garnish. The new procedure seems to be file the arbitration claim, then take the award to court to be affirmed, then garnish. I've been trying to settle but they have been refusing even 70% of the original balance, and are insisting on 70% of the new balance. I'd like to file a response with the arbitrator since it's free for me and costs Wolpoff/MBNA
$450 and might make them more willing to settle. Anyone have any ideas as to what I could say?
