I have NO idea why this shyster is trying to make an end run around the court system. As I told "Gabe" I do NOT believe this is a legitimate filing of arbitration from the arbitration company. I think NCO is trying to shake-down people illegally, (or at least under the table) technically speaking, since he is not threatening legal action he is not in violation of the FDCPA. I would try filing a cease and desist letter to him,with a copy to the arbitration company,stating that under FTC law, any unilateral arbitration agreement on a credit card application for personal use is not binding as the Federal TILA and FDCPA consumer rights can not be abrogated. You can refer to the case law of the citation I gave. In addition you should file a complaint on line with the FTC and include the case # you will receive in your letter. I believe there is a LOT of action legally on this issue, and if you contact the resources I posted you may find you can get in on the action and possibly win $$ instead of paying $$.
