I did get their standard letter advising me of my rights and their actions on behalf of MBNA a few weeks before the arbitration stuff came. It does contains all the required info. I do not believe that NCO is involved with this. All the addresses point to Wolpoff here in MD..they are just down the street from me. It seems to me that Wolpoff and MBNA think they have a legal and legitimate means of collection (faster and better then the courts) based on the arbitration clause. They get a quick decision and go from there. I don't think they are pulling a scam. I think they are trying to create a new means of collections and find another way to screw people. I talked to an attorney friend this morning, and I might be able to counter sue and claim that the arbitration violates the FDCA, but it's a tough play. You are correct in that I will need a high powered consumer attorney. From my perspective I'm not sure it's worth it.
