They are blowing smoke!!
Send them a cease and desist and notify them they are in violation of the FDCPA for threatening legal action that cannot be carried out. The TILA defines credit card debts as open accounts, the FDCPA and Federal and State UCC laws state that the cause of action (starting date) is from initial default. NO convesation, or admission of debt, or even payment on account changes that. Tell them you will sue THEM if they don't slither back under their rock.
