As I understand your post, at the time of the divorce your wife agreed to pay off the balance then due, and did so. You were the only one who could have removed your wife from the account as additional user for future charges, and you did not.For whatever reason, she charged $34. and didn't pay it. It would have had to have taken a long time for this account to have gotten into this condition, all of which would have appeared on your credit reports. I do not see any fraud here.I do not know why your ex wife decided to use the card and not pay, I do not know why you did not check your credit reports on a regular basis.I suspect there is possibly more to the story than the $34. charge.However, the simplest way to handle it would be for you to pay it in full. No one seems to be deserving of a "fraud" charge here. Certainly not Sears, who could not know you didn't want your wife to use the card, since you didn't tell them. Certainly not the CA, who would not have the account now if you had kept track of your credit reports. As to your ex wife "screwing you" as the other post suggests. I don't think anyone who wanted to do that would be foolish enough to do it with a $34. charge. Where were the bills going? To your address or hers?
