As I read it, and I am NOT a lawyer, Randolph sued Greentree and not Greentree going after Randolph. If a CC pursues arbitration and wins and the court affirms for garishment, then BK maybe a logical choice. But if your state has sufficent defenses against garnishment, such as head of house hold exemptions, it might be better to go that route. If you have any money at all, have direct deposits and you think that a garnishment is pending; and if it were me, I'd lower my balances. If you realy do not want to go the BK route, try to work out a repayment schedule over 4-5 years and see what they say. Your best bet would be to consult with a BK attorney. Most offer free 1st appointments.
