Only one collection agency law firm is using the "arbitration" clause as a weapon in debt collection. It is NOT valid, however a lot of illegal crap gets through the lower courts and then has to be appealed. I would file BK NOW, not later, not because of this, but because once the MBNA lobbiest funded changes to the BK Act goes through, NO ONE will be able to do any kind of BK without a BIG hassle.
