You should do something to protect your sale,if the new buyer gets in the middle of a judgement you could lose it. Why don't you consider filing bk,maintaining your legal residency and homestead exemption and renting the house out?You should file a homestead exemption with the courthouse asap anyway, ( this is NOT the same as homestead exemption on property tax)
