Yes, you can just call and ask them - usually they know the time frame for archiving records for that particular court. I found out when I called to ask if anyone had ever updated the judgment to "paid." They told me it was archived, would take two days to get the file. I think it varies from place to place. This was a paper file, and it only took two days to get it...

My feeling on sending the court docs to the CRA's is that once you do that, you will never be able to get them to remove the derog early. So what you do depends on how you want it to go later. If you believe in "doing your time" as far as the 7 year reporting period goes, then send them the docs, and have it marked paid. If you plan on trying to get the derog off early by disputing it with CRA's later, then make sure the court record is showing paid, dispute the account with CRA's as incorrect, but don't send them what they need, make them get it (cause a lot of the time they don't bother).

I've been there, done that. They won't take it off if you have sent them the proof they need to keep it on there the full 7 years without them having to get the court docs themselves. They flat out told me "you sent us such and such a document, dated xxxxx, so it will not come off until yyyy."

My other thought on that is, why are we required to do their legwork for them, for free, if we want our files to be accurate? If you don't need it fixed immediately, then make them do it, on general principles. It's annoying to know they have it wrong, and tempting to prove that they've screwed up, so satisfying to see it change, but the current system stinks, they're making a profit out of making our lives difficult, let them pay for it.

And even if you need a mortgage, usually all you need is the court docs showing the judgment is satisfied. The credit report inaccuracy would be ignored if you have your proof you've paid.

Just my opinion - I hate doing their job for them for free, avoid it when possible.

Linda
