I would suggest you see a real estate lawyer in your area. Fl. changed it's lien laws Oct. 2001.On judgements filed before that date, the have to be REFILED bt Oct. 2003 to remain in force.Your lawyer has the option of contacting the lienholder of record on the existing judgement and negotiating a payoff and release, OR escrowing the amount of the judgement at your closing,and waiting until after Oct 2003 to see if it has been refiled. In the first case, you would get it over with and perhaps the creditor will settle for less to release, although it is likely they will want the full amount plus interest and will immediately refile to protect their claim.In the second case, you would still have the full amount of the judgement tied up for a period of time,and might still have to settle or pay the full amount OR --if the creditor ignores the refiling date(with NO contact from you or any lawyer) you stand a good chance o getting all your escrow back.
