I have a question on a 9 yr old debt.My ex boufriend and i bought a car in 92,i cosigned for it(mistake). He took back to bank for voluntary repo.They came after him with a judgemnet and filed in 93 and served him ....I was never even served..I didn't know anything about this judgement until recently last yr in 01 i received a letter from my employer stating wages will be garnished...I filled out a wage statement to the levying officer and they sent a letter to the collection agency for a notice of opposition.collection agency never responded. now 7months letter they are going to garnish my wages again...First of all my ex filed bk so they have a right to come after me,but we were never married and they have filed me with his name on it.is their anything i can do to them to avoid bk..my credit is good now and i dont want to ruin it by bk,i am trying to purchase a home soon.What is a letter to vacate a judgment? can this fall into my category..Do you think i can win case..I have two kid to support and they want to take out 50% pay..please respond quick..Collection agency said i have till next monday to respond with their settlemnt which is 50 a month till 11,000 is payed up that is more than the car..outrageous intrest has accrued..Should I respond with the settlement pay them monthly to buy time and then get a house and what i want ,then file bk?
