I have a 9yr old date.it was an act with an ex boyfriend..I cosigned a car for him.This was in 92.we broke up he took car back to bank and they filed judgment on him in 93.he filed bk recently and now last yr in 11/01 i received a letter from my employer wages where going to be garnished.I filed a wage form to the levying officer,they held onto the money and sent a letter to collection agency they have 15day to repspond with a notice of oppostion ..They never responded.Now 7mnths later the collection is going again to start to take out wages.I don't want to file bk.my credit is good and i want to buy a home.Is there anything I can do? What is a letter to vacate judgment can I file since i wan never properly served? also on the jugment they have my name as married to him which we were never.Is that something to go on to win this case.My last resort is bk but if i have to i will.I contacted the collection agency because they keep on calling my work stating how come they stopped the wage garnishment and the reason did because the levying officer relese ganishment because they never responded.THey said they willsettle for 50 a month. the debt is now up to 11,000.that will take me forever and that is more that what the car was worth,jus intrest accrued.Please someone out there please help.What is the sol in California,on a voluntary repo?They never collected on the judgment when they filed in 93.Also do you think the judge will take in consideration I have 2 kids to support by myself?
