First thing Monday morning, go to the courthouse or call to find out how you can go about filing a Leave to Plead. Here in Ohio, you have to do it in person. Tell them you need more time to Answer to the Complaint. If you haven't already requested more time, they should grant you the time extension. Its nothing big. It doesn't involve the judge or anything, its a simple form you fill out basically saying you need more time to Answer. It will give you another 28- 30 days to file your answer. If you need to give them a reason, say you are seeking representation. A OC/CA has the right to correct themselves when they error in reporting to CRAs, sometimes its favorable to the consumer sometimes not. In this case, it wasn't. As long as they can prove it is a legitimate debt owed they are within the law. Its seems what happened is that this OC charged the debt off with the balanced owed. The CA bought this debt and tacked on the accrued interest. Believe it or not, its all legal. However, you have a right to validate the account. To analyze the activity of the account to make sure all the numbers add up to what they claim you owe. Aside from what the credit report says, did you pay this account off?
