Capital One credit card

We applied for a Capital One credit card in Spring of 99,
when the card came we decided we didn't want it after
all, and cut it up and wrote on our bill for our annual
fee that we didn't want the card. Well, when we were
doing some real estate transactions months later, the
annual fee on the Capital One card we returned and did
not use, came up as a bad debt. Our attempts to erase
the debt were ignored by Capitol One, we wrote them,
spoke to them directly and no one would erase this debt!

Does anyone have a suggestion on how to deal with this?
