Well, don't stress to much My husband owed 5,600 to Discover 7 years ago, its finally been deleted off all but one credit report. (still waiting two more months for that one)

HE WAS NEVER SUED.

In fact just this past March we decided to settle with them for moral reasons.

The collection agency they sold the debt to was NCO and I negotiated with them. Since having the account for years with their fees the amount owing was 13,700. I settled over the phone with them for 3,000 payable in three days.

We didn't need to do this as the SOL was up, but my husband felt better to pay it as we are now financially very well off at this point in our lives.

So, I guess depending on the amount of the debt you could be sued but like I said, my husbands was 5,600 and they never sued. This was back in 95 when the thing was charged off, maybe their rules are different now, I can't say.
I just know from experience what happened in our case. I am not talking from the side of my face, and I am not repeating information "I heard or read". This really happened to Us.
