Ken, this account is too new to do what you are doing. If you are in dire straits, like lost you job, accident or illness, and don't have any money, tell them. They think you can pay.

If you really can't pay and they don't agree to work with you, at this point all you really can do is ignore them and keep a low profile. If you do have assetts - real estate, bank accounts, etc, they can (and might) take you to court.

The letters usually only work well on older accounts - I'm not saying you can't succeed in getting them in a violation - it's entirely possible. But they would not have a difficult time in court proving this is yours. Providian has probably not even written this off yet, and the CA may even be Providian's in-house collection arm.

I have to assume nobody in their right mong would just default on a debt if they really could pay it. If you just got in over your head, but you still have a job, own a home, etc. you are in for a tough time, I imagine. You might be getter off negotiating payment terms and salvaging what is left of your credit. Life can be difficult with bad credit these days.
