Thank you, this information has helped. I live in Missouri. I think the SOL for credit debt is 5 years. But as far as the SOL goes, I don't really know how to begin counting down the 5 years. Is it from the time they received my last payment, or will it be from when they considered me delinquent, or when some of them were charged off? I never sent for a credit report, so I do not know. And I dare not try to get one at this point. In August 1997, my husband was denied Social Security Disability because of eligibility time limits, but was approved for SSI, a very hard life for us since then. I stopped using the credit cards immediately at that point, and stopped paying on them. One of the credit companies got the judgement against me through a local attorney-collection firm because I didn't answer them. It was at a very difficult time in our lives. Since then, they were going to do it again, representing another credit card, but I wrote and explained our situation, and never heard from them in well over a year. They stopped asking me to pay the judgement also. But I fear that they are just waiting for my husband to die so they can enforce the judgement and seize the house. It is only worth 21,000 and the judgement was originally for about 7,000. Could they do that? What if I died? Could they take the house from my husband?

Please tell me, how can I get the proof of the SOL running out for the other debts we have without running a credit report or inquiring within the companies? I don't want to stir anything up if I do not have the proof I need to defend myself. I have to say that bankruptcy seems to be the answer for us. My husband is only 5 years from Social Security, and he will never be well enough to work. I stay at home to care for him. Our income will not change. Sometimes I think the bankruptcy would bring us peace from all of this.
