There probably isn't any "affidavit" - they say anything to scare you. Affidavit is a big word to them, so they think you will be scared.

Send the cease and desist letter, use certified return receipt mail, and keep the receipt and a copy of the letter. Don't call him, don't talk to him if he calls you. His weapon is to scare you. That's it. That's all. This agency bought these old, out of date debts to try to make a profit. When you don't go along with it, they will move on and find someone who will not fight them. They don't want to spend much time on you if you're difficult. And once you prove you know your rights, they will leave you alone.

If they don't, get a police whistle and blow it into the phone. Tell them to hold on, and just put the phone down and go do something else. Put your three year old on to talk about his fun day. Play the radio for them to listen to. Anything but listen to him trying to scare you.

They can't do anything to you. They are not going to sue you. If they can't talk to you on the phone they won't get any money, because you won't be scared. So they will call someone else who IS scared and DOESN'T know the law or his rights.

Send the letter and forget them. They can't hurt you.
