I had a credit card back in 1990 which I had a $3000 balance which I never paid. On 7/5/02, I rec'd a call from a bill collector at my mothers house in NY (havent lived there or in NY in 3 yrs)and they left a message on her answering machine saying "We are calling for Scott XXX regarding a lawsuit being filed against him and we need him to contact our "prosecuting attorney" as soon as possible." They left a phone number and case number to call. I called the number today and though the person handling my case was not in the man answering the phone told me that this was in reference to a Citibank MasterCard account from 1990 that had a balance of $3000.00 and is now at $6000.00 with interest. He also said that I could settle it for they original amount of $3000.00 and avoid having a lawsuit filed against me. He then offered to transfer me to the persons Voice Mail who is handling the case and once he did that I hung up. I did not give any info on my whereabouts, financial situation or intentions. My questions are - being this account is 12yrs old do I have to pay it or has the statute of limitations run out ? Was this collection agency allowed to leave the type of message that they did on my mothers answering machine stating that I was having a lawsuit filed against me ?? Any help is appreciated. PS - The state of the debt is NY and I now reside in FL.
