Annual Fee Delinquencies

After filing for bankruptcy in March 2000 and paying a service over $500 to help clean my credit reports, the next hurdle evolved.

I found an old credit card in the drawer from Orchard Bank. I called to see if there were any low rates available. Well, the person I was speaking to was in the collections dept.

They solicited me in early 2001 and I accepted their $500 credit limit with an $89 annual fee in hopes of improving my FICO score.
Well, I only used the card a few times and the last time was in June 2001 and I paid it off. I moved in July of 2001 and submitted a change of address to the post office and rented a 6 month po box. This was to get rid of junk mail. Well, it back fired.

Supposedly, when the annual membership fee came in Feb 2002, they mailed a statement to that post office box. Remember, I never gave them that po box number. The box expired on January 23, 2002. So, any mail sent to that box should have been returned undeliverable.

They say I owe approx $300 which includes the annual fee, late fees, and interest. The money is not the issue in my eyes. They have submitted derrogatory comments to the credit bureaus. My FICO score on Trans Union made it to 700+, I'm terrified to see what it looks like now.

The same company that worked on cleaning my credit report sent a certified letter to Orchard explaining the situation. Their response was "borrower is still responsible for entire amount".

A few facts that may or may not help:
1. I never signed the back of the credit card
2. I don't think I ever filled out an application, simply phoned the number on the card for activation.
3. Never received any statements -- account was paid in full.
