The reason those payments are hiigher than the normal cc minimum is you represent additional risk to the cc company. They are trying to recover as much a possible in the event you default a second time.

As to a lawsuit. Who knows? You don't have to have assets to be sued. You can be sued and not pay and then you have a judgment hanging out there accruing interest and it's right there to snaggle anything you may eventually acquire. Also, they can place a lein on your house or, if you get a job and, state law allows it, they can garnish your wages.
