i live in pennsylvania, and ijust came across this website.

last week i got a call from a collection agency in new york. this was regarding a charged-off credit card from 3 years ago. the original amount is $1400.

after the account went to charge-off status, they got one small payment from me in december. since then, no letters, calls, etc from anyone. suddenly on july 11, this collector called 'national capital funding' calls me and gets real nasty, and gives me all these threats such as lawsuits, my assets taken, bank accounts frozen, and said i could be imprisoned for 2 years. i received absolutely nothing from this collection agency before they called.

i called the original creditor and they sold the account to one other agency before it got sold to national capital funding. NCF claims they got the account in march, but i received nothing from them. they demanded payments from me that day (but i could not pay them anything) and they said if the payment was not in full by the last day of this month, the lawsuit would take place within 2 weeks.

NCF also refused to give me their postal address, and say they only accept payments by western union or checks by phone. i think they will not give me any written notice because i would get their postal address.

is it legal for them to just suddenly demand payment on short notice with all these threats, and not give me any written notice? and i also do not understand why they are keeping their postal address a secret.

should i pay these people (but i know doing so will extend the statue of limitations)either in full or a partial payment, or are the just making these threats as a way of making me pay them? they really have me stressed.

please email me to horse@unidial.com
