I'm going to doubt those counterclaim arguments will carry any weight. There is nothing in either the FCRA or the FDCPA that says a creditor can't sue you anytime they like. A lawsuit is not continued collection activity. Also, as recent as this chargeoff is, I'll bet Cap. 1 still owns the debt and as the OC, the FDCPA doesn't apply.
