The SOL starts wth the FIRST "late" payment . If your husband was "paying off" an overdue account in 1997, then it must have become delinquent some amount of time prior to that.In any case,your first concern should be, as Linda said, with the validity of the CA's claim. You DO NOT want to negotiate or even ADMIT to owing anything at this point.IF they actually filed legally, and your husband was legally served, (which I doubt) then you need to respond to the Court, NOT to the CA.If it is NOT an actual legal action, then use the SOL letter (http://community-2.webtv.net/Y-Chat/WhyChatsCredit/page3.html)
from my website. Click "HOME" to get the 1st page, click New York to get the statute # and use any date prior to June 1996 for the default date. The CA would have to have complete account documentation (and CA's NEVER have it) to refute your claim.
