I would send the letter now, giving the SOL as 4 years, with both statutes referenced, BUT put your CORRECT date of FIRST delinquency or default at 180 days prior to your known chargeoff date- The charge-off date is for the credit report SOL,prior to Dec. 1997 there was no reporting of first date of delinquency, so YOUR records of being beyond even the 5 year SOL, ON RECORD with a RRR letter to the CA, will save you all sorts of future problems.
