collection agy threatening; acct deleted from credit report

I have a charged-off account which i got deleted from my credit report a year or two ago. It has not shown up since. suddenly a collection agency called threatening legal action and imprisonment and such, and offered me a settlement. if the settlement was not paid by the last day of this month, then the legal action and all that would take place. now, i thought if you could not make the settlement, you pay the rest of the balance. just because you cannot make the settlement, that should not mean you would get sued. this CA would not let me make monthly payment arrangements. i cannot pay them anything. what do i do?
