cannot pay rest of settlement

i was offered a settlement from a charged-off account. original amount was $1400 and settlement is $1000. i paid $700 of this settlement. they said if i do not get the remaining $300 in by 6:00 EST today then they would file suit. can they legally do this? if the settlement was not fulfilled within the given time, then the balance goes back to the original amount, right? and they should allow you time to pay that off.
