If you are not responsible for the debt he can call you one time and only one time.
You need to get his address and fax number and send a certified letter and fax letter stating you wish him to cease and desist all communications.
statute of limitations on an open ended account(such as a credit card)
mo-5
ks-3
co-6
Unless I am badly informed I believe the statute only deals with the state you live in or the state the debt occured in. Therefore the debt is past the statute of limitations and he cannot collect. If he calls again feel free to point this out and also put that in your letter. Tell him if they file suit you will coutersue for fraud, slander, defamation of character, and frivolous lawsuit. IS this debt a cc debt or what is it? Also, what is the name of the collection agency who is calling you. email me at picantel4343@hotmail.com stating who you are and I can email you a list of nice statutes that will make his hair stand on end. IF that does not work when he calls I can give you my # to give to him and I can have a nice little talk with him.
