The statute of limitations in ohio and georgia are 4 years on an open ended account of which a credit card is. I also have a credit card from citibank charged off in 1994. They cannot collect on this debt. IF they call first ask for their fax number and address. Mail them a cease and desist letter certified so they have to sign for it and fax over a copy also. Be sure to tell them the SOL was up 4 years ago and the debt is uncollectable. Also remind them that future efforts to collect will be met with serioous consequences which could include slander, defamation of character, harrassment, and fraud and if they file suit against you then you will counter with the SOL and seek damages for filing a frivolous lawsuit. Also be aware that telling you they are sna is another violation of the FDCPA. They must give you the full name of the agency along with address and any pertinent info such as the phone and fax numbers. When a CA attempts to collect on a SOL debt they are running an extremely fine line as you have nothing to lose and they have everything to lose. Let me know what happens after they call next.
