We live in Kansas. And, it was the collector who told me that he was going to tear up paperwork that he was going to send us to look over to get the loan out of default because I cited the FDCPA. Plus, he informed me that his agency would put in the garnishment, when I thought it had to be done by the guarantee agency and not the collector...anyone know if this is true or not.

At any rate, we send the validation and cease and desist letters. He called the day we sent it, and had called my husband at work again, my husband explained that he was in the middle of something and could not speak to him. The guy kept talking and told my husband that he could do a deal to take the loan out of default, said we would have to make some high payments of like 600 bucks and then maybe my husband could get the payments lowered. My husband just got firm and said he was working and could not talk at work.

My husbands supervisor is not around a lot. Actually, my husband is a supervisor at the company. Personal calls have not been outlawed at work, however, we both work in social service and there is no place to have a private conversation, and my husband is so busy that it is very difficult for him to answer an overhead page, but he has to answer it in case it is an emergency or related to the job. It is a great inconvenience for either of us to receive calls at work...that is why we have a cell phone and we even work at the same company.

Oh, the loan is still with the state guarantee agency in Nebraska. They have not turned it over to the Dept of ED yet. but I guess the state guarantee agency can still garnish. They are using a collection agency with the initials RAB.
